Terms of Service
These terms govern your use of the Sailing Jury Decision Google Workspace add-on and the companion bookmarklet (together, “the Software”). By installing or using the Software, you agree to these terms. If you do not agree, do not install or use the Software.
1. About the Software
The Software is a personal-effort tool maintained by Yoann Peronneau (“the developer”) to assist sailing jury panels in drafting and filing race decisions. It is provided free of charge as a contribution to the international sailing judging community. The developer is a private individual, not a company.
The Software is not affiliated with, endorsed by, or sponsored by World Sailing, any national sailing federation, the operators of sailti, manage2sail (m2s), or racingrulesofsailing.org (RRS).
2. License to use
The developer grants you a personal, non-exclusive, non-transferable, revocable license to install and use the Software for the purpose of drafting and filing sailing jury decisions, subject to these terms.
The Software is proprietary. You may not:
- Copy, modify, or create derivative works of the Software.
- Distribute, sell, lease, sublicense, or otherwise transfer the Software to third parties.
- Reverse engineer, decompile, or attempt to extract the source code, except to the extent such restriction is prohibited by applicable law.
- Remove or alter any copyright notices or attributions in the Software.
- Use the Software in a way that violates applicable law or the terms of the platforms it integrates with (Google Workspace, sailti, m2s, RRS).
3. Your responsibilities
You are responsible for:
- The content of the jury decisions you draft using the Software.
- Ensuring the accuracy of facts found, conclusions, and decisions before filing them.
- Complying with the Racing Rules of Sailing, your national jurisdiction’s procedural rules, and the terms of service of the platforms where you file decisions.
- The security of your Google account and your access to the documents the Software reads.
The Software is an aid to drafting and filing. It does not validate the legal or procedural correctness of your decisions. Final accountability for filed decisions remains with you and the jury panel.
4. No warranty
THE SOFTWARE IS PROVIDED “AS IS” AND “AS AVAILABLE”, WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR UNINTERRUPTED OPERATION.
The developer does not warrant that:
- The Software will be free of bugs, errors, or interruptions.
- The Software will integrate correctly with any specific version of sailti, m2s, RRS, or Google Workspace (these platforms are operated independently and may change their interfaces at any time).
- The Software will be compatible with any specific browser, operating system, or device.
- The data extracted from your documents will be complete or accurate (the Software relies on the document being in a known structure; departures from the template format may produce incomplete extractions).
5. Limitation of liability
To the maximum extent permitted by applicable law, the developer shall not be liable for any direct, indirect, incidental, consequential, special, or punitive damages arising out of or related to your use of the Software, including but not limited to:
- Errors in jury decisions filed using the Software.
- Loss or corruption of decision documents.
- Failure to meet filing deadlines due to Software unavailability or malfunction.
- Disputes arising from decisions drafted with the Software.
- Costs of substitute tools or procedures.
This limitation applies whether the alleged liability is based on contract, tort, negligence, strict liability, or any other basis, and even if the developer has been advised of the possibility of such damage.
If applicable law does not allow the limitation of liability for certain damages, the developer’s total cumulative liability shall in any event be limited to the amount you paid for the Software, which is zero (€0).
6. Updates and changes to the Software
The developer may release updates, modifications, or new versions of the Software at any time. Some updates may require you to re-authorize Google account permissions. Continued use after an update constitutes acceptance of the updated Software.
The developer may also discontinue the Software at any time, with or without notice. In that event, your license to use it terminates automatically. You will retain any decision documents you have created — the Software does not hold them hostage.
7. Termination
You may terminate these terms at any time by uninstalling the Software from your Google account (https://myaccount.google.com/permissions) and removing the companion bookmarklet from your browser.
The developer may terminate your license under these terms if you breach them. Termination does not entitle you to any refund (no purchase was made).
Upon termination, the license in Section 2 ends. Sections 4 (no warranty), 5 (limitation of liability), and 9 (governing law) survive termination.
8. Privacy
Your privacy is governed by the separate Privacy Policy available at https://jury.peronneau.net/privacy.html. Please read it.
9. Governing law and jurisdiction
These terms are governed by the laws of France, without regard to conflict-of-law rules. Any dispute arising from these terms or your use of the Software shall be subject to the exclusive jurisdiction of the competent courts of France, except where such exclusivity is prohibited by mandatory law (such as for consumer protection rights in the European Union, which entitle you to bring proceedings in your country of residence).
10. Severability
If any provision of these terms is held invalid or unenforceable, the remaining provisions remain in full force and effect.
11. Entire agreement
These terms, together with the Privacy Policy, constitute the entire agreement between you and the developer regarding the Software. They supersede any prior or contemporaneous communications, proposals, or agreements.
12. Changes to these terms
The developer may update these terms from time to time. The “Last updated” date at the top will change. Material changes will be communicated via the project website at https://jury.peronneau.net/. Continued use of the Software after a change constitutes acceptance of the updated terms.
